A Sheriff Just Threatened Charges Over ‘Fuck Trump’ Sticker — and the Internet Is Destroying Him

(ANTIMEDIA) A Texas sheriff is under fire for making a Facebook post about his intention to take punitive measures against a truck driver displaying a bumper sticker declaring “FUCK TRUMP AND FUCK YOU FOR VOTING FOR HIM.”

On Wednesday morning, Sheriff Troy E. Nehls of Fort Bend County, Texas, posted a picture of the back of a truck asking members of the community to help him find the ‘offender.’

“I have received numerous calls regarding the offensive display on this truck as it is often seen along FM 359. If you know who owns this truck or it is yours, I would like to discuss it with you,” he said.

Nehls apparently already sought to impose punishment, adding, “Our Prosecutor has informed us she would accept Disorderly Conduct charges regarding it, but I feel we could come to an agreement regarding a modification to it.”

He also posted a picture in the comments of legal code concerning disorderly conduct, apparently attempting to justify his attempt to suppress free speech by suggesting the truck driver was instigating a breach of the peace.

The statute, Sec. 42.01, says “a person commits an offense if he intentionally or knowingly uses abusive, indecent, profane or vulgar language, and the language by its very utterance tends to incite an immediate breach of the peace,” or if it “makes an offensive gesture of display in a public place, and the gesture or display tends to incite an immediate breach of the peace.

Attempting to cite this statute suggests Trump supporters could be so triggered by free speech about the president they might incite violence, a particularly hilarious notion considering the right has spent months virtue signaling about the first amendment and scolding leftists for being violent snowflakes.

And the Internet responded swiftly as thousands of commenters flowed in offering relentless trolling, thoughtful defenses of free speech, and cutting rebukes of partisan hypocrisy. The trolls were numerous:

    Ah, yes…brings back memories!
    A little over 30 years ago, I was ticketed for a “SHIT HAPPENS” bumper sticker in GA. GA had a similar statute where they also tried to circumvent federal law/U.S. Constitution, by calling it a “traffic hazard” and for about the same reasons as cited here.
    ACLU took the case; if memory serves we also cited the ‘fuck the draft” jacket case.
    There is a three prong constitutional “test” for obscenity, which is what governs, and political speech is one of the 3 tenets that are protected.
    To be obscene, it also has to be of a sexual nature, so we had a GA State University sociologist testify. One of her specialties was “Coprophilia” – or the use of shit in sex, by coprophiliacs!! 🙂
    When asked if they ever refer to it as “shit” when using it in sex, she testified that no, they used euphemisms such as “chocolate brownies with fudge syrup”, or the like.
    Point being, the state has to prove that the supposedly offensive word is being used in a sexual nature – which in my as well as this and the jacket case, it is not. And again, political speech is protected on its own.
    Funniest part of my case was that even after being told it was a constitutional issue over protected speech, they found me guilty anyway. Jury foreman, a 2nd grade school teacher, said simply that by the time the kids get to her level in school, they know it is a “bad word”.
    Went right over their head it was a constitutional issue; we had to go to the state supreme court to get the law thrown out.
    Note to self: don’t ask for a jury trial unless you’re guilty as hell and your only hope is sleeping jurors who may fuck up and let you off – if you’re innocent, may be best to go with a “judge trial” so you don’t risk your ass by putting it in the hands of drooling idiots who only want to get out of there as fast as they can!
    This fuck trump case should be pretty quick and simple – unless they get jurors who are slow and simple! 😉
