Cops Charge Sick Mom After Child Corrects School About Health Effects of Cannabis

Op-Ed by Josh Paniagua

(ANTIMEDIA) Most Americans who attended school after the year 1983 are likely familiar with D.A.R.E., a privately and federally funded anti-drug program notorious for using exaggerated facts, falsified science, and fear tactics to scare kids into “just saying no”. Not only is their approach to drug prevention laughable (at best), it is a complete and utter failure.

As if spreading misinformation to children isn’t despicable enough, it would appear that they are willing to ruin lives to protect their propaganda.

Shona Banda is a mother of two living in Kansas, sufferer of Crohn’s disease, and cannabis oil activist who has recently fallen victim to US drug policy. On March 24th, Shona’s 11-year old son and the rest of his class were visited by D.A.R.E. officers. During the drug education class, Shona’s son, knowing his mother’s life was saved by cannabis, decided to speak up to inform them that the information they were giving was incorrect. From there, he was detained and questioned by Kansas State authorities.

After realizing that her son was late coming home from school, she contacted the school office and found out that her son had been taken by police.

“My husband and I are separated and neither parent was contacted by authorities before [our son] was taken and questioned,” Banda says in an interview with Ben Swann.

Based on the information they obtained from interrogating the 11-year old boy, police developed a suspicion of illegal substances on the property and obtained a search warrant hours later while prohibiting Banda back into her home until the warrant was approved and executed.

Police found and confiscated two ounces of cannabis and one ounce of cannabis oil. In other words, police broke in and stole this sick woman’s medicine and proceeded to take her child into custody.

“On the 24th, he was taken into custody. That was on a Tuesday. He was taken out of town Tuesday, Wednesday, and Thursday. Friday we had a temporary hearing… and temporary custody was granted to my ex. Now the only reason why temporary custody was granted to my ex is because the judge said something to the effect that the amount of cannabis found in my home was going to possibly be felony charges and it was pointless letting the child return home to his mother,” Shona says in her interview with Ben Swann, “The state is trying to deem it to where [Shona’s ex-husband] is not fit and I’m not fit and they’re trying to take custody of our child.”

Coincidentally, Shona has a hearing regarding custody of her son on April 20th (4/20).

Please support her legal fund here.

Do these people ever stop to wonder what kind of image they’re actually portraying by enforcing such ridiculousness? The kind of people willing to rip a child away from his mother because of the type of medicine she takes for a serious illness don’t seem like the most ideal people to take any sort of advice from. Unless, of course, one seeks advice on how not to win a war on drugs, how to lie to children, and how to tear families apart in the name of outdated and outrageous policies.

  6. Kidnapping, unlawful detainment, breaking and entering, theft, assault (I say that cause im guessing they had to physically detain him, ie touch him). Sounds like a lawsuit. But of course cps will use this, she'll lose her kid. There was no mention of medical card, so im guessing she's gonna go to jail. This is crap, feds give pigs too much power.

  9. Why the devil can't these goon stepping thugs pay attention to the medical RESEARCH and stop this insanity!!!!! They ILLEGALLY detained an 11 year old boy to do this! The last time I checked, you cannot hold a child like this WITHOUT HIS PARENTS!!! Do these people have any shame at all? Nope! That's the entire problem with this 'war on drugs': it's a war on families, people, and medication brought about by cops, Big Pharma, and nonsense.

  10. OK, why is no one listening I have been for two weeks been trying to warn the American Public about the upcoming deadline June 1, 2015 when the thee (3) ACTS that President Bush passed thru Congress in 2005 after 9/11. These Acts were: The Privacy Act, The Patriotic Act and Tribunal Act. Which eliminated our Civil Liberties and on June 1, 2015 their expiration will delete forever the following: Our Declaration of Independence, U.S. Constitution & Bill of Rights. Basically our Protection thru Government for receiving these rights –Our physical Protection from the Federal Government to guarantee that we receive these rights and finally Our Bill of Rights the singular rights we've attained thru the years. So no more protections under any laws NONE — WE RIGHT NOW HAVE NO RIGHTS BECAUSE WE ARE ONLY LESS THAN 45 DAYS AWAY FROM LOSING EVERYTHING – WHEN I TRIED WARNING EVERYONE THEY JUST ASSUMED THAT I WAS LOCO OR COO COO FOR COCO PUFFS! The only thing that will save us is to insist that our Democratic leadership immediately submit a petition of reinstatement into Congress that overrides any petition already submitted before the deadline June 1, 2015. Which should be two weeks or so May 15th or no later than May 22, 2015. I have secured a date for a rally and protest in San Francisco on Friday, May 8, 2015 at 12:00 noon to demand the reinstatement of our U.S.Constitution, Our Declaration of Independence & our Bill of Rights because of now — UNDERSTAND ME NOW — WE HAVE NONE — THIS IS NOT A JOKE — WE DO NOT HOLD ANY CIVIL RIGHTS AS NOW — WE WON'T UNTIL THESE ACTS EXPIRE IN JUNE 1, 2015 BUT WE MUST HAVE OUR OWN PETITION FOR REINSTATEMENT OF THESE UNALIENABLE RIGHTS AS SOON AS POSSIBLE BY OUR POLITICAL LEADERS!!

Cuz right now, not sure they would want what most would say they/we deserve. Time to get it together as a nation. This shit is getting out of hand. And the world knows we are falling apart.

  15. this is good. when this kid goes back to school and tells all the kids what the police did the kids wont trust cops anymore and it will stick with them for a long time. the only thing i can think of is cop proofing your kids. ive taught my kid so say over and over "not without my parents or a lawyer" when being questioned by cops. i told her if they hurt her she will get a lot of money off of it and that no matter what they tell her she will be ok. if a cop ever hurt my kid the law wouldnt stop me from anything and i would deliver the cops head to my kid on a stake before going to jail and not giving a fuck all while becoming the coolest new guy on the cell block.

This is fucking ridiculous how people can just be so closed minded especially when there are facts that marijuana is very beneficial to someone's health especially someone with an illness as severe as this woman's. How can these police just take her kid without her consent knowing damn well they're going to brainwash him because he's so young and vulnerable and tricking him by being fake and get him to talk?! Money hungry sociopaths is all I have to say. Can't stand this state!

  21. So, if the child were in school and started talking about how his mom takes Vicodin for her pain or nausea medication or even Oxy, then it wouldn't be a problem. The worse of the pain medications that cause people to have liver failure, heart failure and other side effects that can lead to death if abused and that would be okay. But since she is using pot to help with being able to eat, calming her intestinal irritations, pain related to the disease and not causing any other ill effects to her body, they arrest her and take her son? WHAT? What if she were a drunk and the kid mentioned that in school. The teachers would have probably said, "oh, well I hope she gets help" or some crap like that. When are these people going to learn that the only reason pot is illegal is because hemp was positioned to take over the timber industry and the rich timber men didn't like that business. The funny thing is, we all know for a fact that most of those politicians who are trying to keep pot illegal are the ones who are smoking it behind doors. What a bunch of assholes.

I am in agreement, there is too much of law mongers who are trying to get the little man instead of letting people be. Enough is enough.

She moved her family to Colorado so she could get oils for her daughter. The daughter has improved so much. Now is down to only about 5 to 10 seizures in a day and is improving as I type. You are right, this is exactly what she should do, haul up and move out.

That's probably why you shouldn't share your illegal drug use with your 11yr old…I'm sure this lady would smoke regardless of if she had chrones or not…which is totally fine, doesn't make her unfit as a parent…telling her 11yr old the benefits of her getting high makes her an unfit parent. Everyone can stop pretending they want weed legal for medical reasons only…it's totally recreationally legal in Colorado and they turned out just fine…but just like with alcohol, no one should be telling an,11yr,old how awesome it is

  38. It is so unfortunate that the world we live is to dogmatic that they rather remain in their stagnant existence of nothingness than open one's eyes and see the plethora of enormous possibilities….how sad I am for all of you. I spend average of 4-6 hours studying everyday of my life for the past 13 years because I am in love with the world of higher learning — it my life's passion and the filler to any emptiness of heart. I rather go and in silence pray that one day all your eyes may to the visions I am able to see. But today — that day is not. It reminds me of a book that was published in 1884 "Flatland" written by: Edwin A. Abbott. And it is about this two-dimensional existence where everyone only sees how long something is and how thick. Bur the main character sees this same world with the vision of three-dimensional sight. In other words, he sees how tall things are and he tries and tries and tries but these people even they could they are convinced that no it's not. I will close my thought with a quote from Mary Magdalene: "The truth unveiled. For those who have eyes to see, let them see. For those who have the ears to hear, let them listen. For those who have neither……let them pass on." Goodnignt

  41. Jarrad Brazenall Stories like this only feed registered voters the confidence to vote for federal legalization. Even those that are against marijuana have to look at extreme and unnecessary situations like this and realize how wrong it is to give the cops such a tool of system manipulation to utterly destroy lives. For simply choosing a medicinal plant that solves your personal debilitating illness so you might live a better quality of life. 2016 will show if the government will follow the will of the people, or defy us and feed anarchy and further division of citizens from their governing bodies. History proves that you can only starve people so much to where they literally have nothing to lose. When mass quantities of citizens fall into this situation, well, Paul Revere 2.0 spawns.

Illegal weed is the cartels biggest money maker still, make it legal and you would cut the throat of the cartels and eliminate the need and funding of law enforcement to stop it. Its all b ig brother lookin out for littlebrother instead of the American citizens. They want all the money for themselves and not let private citizens make money growin..g and selling it

  52. Incorrect. The Constitution does not grant you your rights. Those outlined in the Bill of Rights are Natural Rights. Inalienable Rights. The Document, important though it may be, is not magical. My god-given right to defend my life and those of my loved ones is not conferred upon me by a document predating my birth. It is inherent.

(To say nothing of the ridiculousness of your claims. Such an escalation would never happen, Law Enforcement does not have the numbers. Most if not all Military would stand on the side of the Citizen. It will be a short stare-down and the State will back off like a bitch, because they pissed off the Military that they Proudly regard as one of the best in the world. It isn't rocket science.

  53. I suggest that you go online look up Patriotic Act, Privacy Act and Tribunal Act and make sure that your are looking at the ones from 2005 because another President tried to do what is being planned for us now, in 2001 by President Reagan. These acts eliminates our civil rights. And our Constitution declares us a Republic and provides us the protection for these rights and freedoms, religion race, culture etcs, it declares this a republic of free men. Now the bill of rights itemizes our rights of due process, rights for warrant, right for lawyer rights to lawyer etc. and our declaration separates us into a separate states of one executive rule but also separate states. If there is no petition of reinstatement in place with prior to its deadline with congress when 06/01/15 and acts exp., we are opened to another petition to set in …..so idiot get a book read about articles and how to protect your democracy before you open your mouth in argument. and start doing your jobs and demand your leadership to look after your needs…..but, wait, you are not men of color so you arrogant warts have nothing to lose but continue being the asses you are!

The U.S. Government owns the Patents to the medicinal compounds in cannabis, Just check out US Patent 6630507 titled “Cannabinoids as antioxidants and neuroprotectants” which is assigned to The United States of America, as represented by the Department of Health and Human Services.
    The patent claims that –
“Cannabinoids have been found to have antioxidant properties, unrelated to NMDA receptor antagonism. This new found property makes cannabinoids useful in the treatment and prophylaxis of wide variety of oxidation associated diseases, such as ischemic, age-related, inflammatory and autoimmune diseases. The cannabinoids are found to have particular application as neuroprotectants, for example in limiting neurological damage following ischemic insults, such as stroke and trauma, or in the treatment of neurodegenerative diseases, such as Alzheimer’s disease, Parkinson’s disease and HIV dementia.”

Your unwillingness to learn about the research that has been done (in even the past 10 years), regarding the effects of many types of cannabanoids on cannabanoid receptors(they're in the brain), is probably the reason why you think "weed" (I'll use your term) is so eeeeevil! As an example I could say that Palm Beach State College is a school for kids rejected by actual colleges. But I'm not going to say that because that would just be a generalization based on sterotypes and misinformation. For all I know it could be a wonderful school, I just don't have all the facts to make an intelligent comment about the school. Any of this gettin' thru?

Honestly this is just another story of what our society as a whole has come to, where people are constantly being shot by cops, kids taken from their homes for use of meds, or parents even letting their kids walk to the playground on their own. They are more concerned with cannabis then the actual most abused drug which is prescription meds. I don't actually consider cannabis to be a drug, but the federal government does. We live in a world where people can rally together over a death they think is racist and not abuse of power, and destroy eachother over it, but we can't stand up to our government and demand impeachment, demand states seceding from the Union all together. We the people have all the power, yet we sit silently and kill eachother then to stand up as one. As long as we continue to sit quietly by, this is the way our life will be and nothing will ever change.

  74. I am so embarrassed at the legal system, the judicial system for letting this happen. This is so ridiculous. I am not a smoker or user of cannabis, but I do believe it does have great medicinal purposes. And if allowed, it can be used for many other ailments as well. My opinion.

  78. The truth is out in the open about cannabis, or "marijuana", it was not illegal because it was dangerous. it never has been. It became illegal because a group of wealthy industrialists were to lose a massive amount of profit. New technology allowed hemp to be processed more efficiently, placing it in a position as a viable commodity. It would be too much competition for this established group of elitists to deal with on a fair market, so collectively and seperately they bought legislature that criminalized the plant, to the extent that economic sanctions would be used against any country that did not go along. A propaganda campaign was waged worldwide demonizing it.
When will they look at the truth?

  81. I've smoked all day every day from the age of 15 to 21. I've grown it, sold it, whatever you can think. I also was addicted,to heroin, coke, xanax and alcohol. There's nothing wrong with smoking weed…it is a safe drug and of,course,it has, medical benefits…but to tell a little kid about it is wrong.

  83. Kansas a real NAZI mean state. The Sheriff's department out in Goodland arrested a lady carrying a small amount of cannabis back home for medicine and they threw her in jail and denied her legal medicine and her illegal(in NAZILAND KANSAS) threw here in a cell and watched her convulse til she died!

  84. First off if someone wants to have a discussion about the negative effects of smoking the plant material, I'm all in. But, to withhold the (beneficial) information to anyone, regarding the consumption of cannabis, is nothing more than pretending you know whats best for someone.. when its clear you don't. That's what D.A.R.E. did to this kid, but for some reason you don't seem to have a problem with that. Maybe for some sick reason you feel its okay to lie to children. I don't know you, but that's my blind assumption. Good luck with your addiction, its a bitch.

  85. I believe you Lorena. Its quite apparent that our rights are slowly being stripped away and the police care less and less when we tell them to their face that they are violating our rights. The one world government plan is already underway and people are perpetually blind.

  87. Absolutly! If the child was not accompanied by a parent/legal guardian then any information they got is inadmissible, and without that information I could never got a warrant, so it is in fact an illegal search and seizure

Seriously though, if we stop putting junk in our bodies (GMO, processed foods) the body can heal itself of numerous things.

  91. Lmao I know the fat kid on the awful grateful dead wife beater with the white trash tattoo and dumbass gauge earrings isnt talkin trash about my appearance!! HILARIOUS!! And for the record kid I dont even smoke marijuana so I certainly won't be having any conversation like that with my daughter any time soon. But if I did it certainly wouldn't justify the police forcibly taking my child from my home and imprisoning me. And like I said before if you truly believe that then you are even less intelligent than your dumbass facebook pictures make you appear. And thats really sayin something! Lol

  92. Look, I'm pro-legalization too. But hemp poised to take over the timber industry? That's ridiculous. Though hemp can be used for a wide variety of products, there is absolutely nothing stopping the people in the timber industry from diversifying their crops. Diversification is a GOOD thing for them, in that it ensures that in the case of a beetle infestation in one forest or some other calamity, they have a backup to take to market. In reality, paper made from hemp is often inferior for mass use (I say this as someone who has experience making paper and binding books), and while perfectly usable, there's not much chance of it replacing paper on a wide-spread scale. While it could certainly replace wood pulp in food (a quite common food additive, usually labelled as 'cellulose'), hemp is impractical for a timber replacement. As a replacement for plywood? Sure, I could be convinced of that. But to replace housing timber or the wood used for instrument making or other such crafts? Hemp wood simply doesn't have the qualities needed to replace those products.

Hemp has a lot of great things going for it. There's no need to make things up or exaggerate; all that does is diminish your position to those who disagree with you, since you've already proven yourself ignorant.

  93. You people are saying Lorena is crazy….when actually she is correct. Time to get your heads out of the sand, people. Martial law is coming….and the provisions are already in place to where our trights are taken away under martial law. See HR 394, I believe.

  94. good luck with that. That is how CPS has ALWAYS worked. They have even more power than the cops. In fact, they tell the cops what to do. And if a cop does what CPS workers tell him to do, he is immune too.

  95. Children SHOULD be educated about things they will see in their homes. Parents should not be doing things they need to hide from their kids. The kids will figure it out, know they are being lied to or having things hidden from them, and be more inclined to lose respect and experiment with things they don't know anything about because people were afraid to tell them. The lies about marijuana are what has caused so much "experimenting" with other things. "If they lied to us about pot, they might be lying to us about the other things"……

  101. my mom was diagnosed with the cancer of the Breast, and the doctor said she had just 3 weeks to live. The doctor told us to carry my mom home to die. After 1week, my mom's health became worse and we had no option than to disclose this to the world by posting for help. I entered a site and viewed Martha's post that Rick Simpson Oil cures cancer and dropped his email. We had to try the oil and contacted Rick Simpson. After 3 days of purchasing the oil, the oil got delivered and we started usage on my mom's breast and always feeding with it.Changes occurred after 2 days of usage and cancer went off before 63days. I am also here now like Martha to share the good news of Rick Simpson's work and by dropping his email to save lives: drpalmerhealthcare@gmail.com … Contact him to save your lives and also share the good news of his great work.
